Section VII. Dendrology parks and botanical gardens

Article 28. General Provisions

1. Dendrological parks and botanical gardens are nature conservation institutions, whose tasks include the creation of special collections of plants in order to preserve diversity and enrich the plant world, as well as the implementation of scientific, educational and educational activities. Territories of dendrological parks and botanical gardens are intended only for the fulfillment of their direct tasks, while land plots are transferred to the indefinite (permanent) use of dendrological parks, botanical gardens, as well as research and educational institutions that manage dendrological parks and botanical gardens.

2. Buildings, constructions and premises that are on the balance of dendrological parks and botanical gardens are not subject to privatization.

3. Dendrological parks and botanical gardens can be of federal, regional importance and are formed respectively by decisions of executive bodies of state power of the Russian Federation or representative and executive bodies of state power of the corresponding subjects of the Russian Federation.


Article 29. The regime of special protection of the territories of dendrological parks and botanical gardens

1. On the territories of dendrological parks and botanical gardens, all activities not related to the performance of their tasks and entailing a violation of the safety of floristic objects are prohibited.

2. The territories of dendrological parks and botanical gardens can be divided into various functional areas, including:

a) exposition, the visit of which is allowed in the order determined by the directorates of dendrological parks or botanical gardens;

b) experimental research, access to which is available only to scientists of dendrological parks or botanical gardens, as well as specialists from other research institutions;

c) administrative.

3. The tasks, scientific profile, peculiarities of the legal status, organizational structure, peculiarities of the special protection regime of a specific dendrological park and botanical garden are defined in the regulations on them approved by the relevant executive authorities that made decisions about the establishment of these institutions.


Article 30. Financing of dendrological parks and botanical gardens

1. Financing of dendrological parks and botanical gardens is carried out at the expense of the federal budget, funds of the budgets of the constituent entities of the Russian Federation and other sources not prohibited by law.

2. The means of dendrological parks and botanical gardens, which they dispose of in accordance with the established procedure, are all the means received by dendrological parks and botanical gardens:

a) on account of compensation for damage caused by the activities of individuals and legal entities;

b) from recreational, advertising, publishing and other activities that do not contradict the tasks of dendrological parks and botanical gardens;

c) in the form of free aid from individuals and legal entities, including foreign citizens and international organizations.
