Section IX. Organization of protection of specially protected natural territories

Article 33. Protection of natural complexes and objects in the territories of state natural reserves and national parks

1. Protection of natural complexes and objects in the territories of state natural reserves and national parks is carried out by a special state inspectorate for the protection of territories of state natural reserves and national parks, whose employees are included in the staff of relevant environmental institutions.

2. The directors of state natural reserves and national parks and their deputies are respectively the main state inspectors and their deputies for the protection of the territories of these state natural reserves and national parks.


Article 34. Rights of state inspectors for the protection of territories of state natural reserves and national parks

1. Employees of state natural reserves and national parks who are state inspectors for the protection of the territories of these state natural reserves and national parks, in accordance with the legislation of the Russian Federation, have the right to:

a) to check with the persons located in the territories of state natural reserves and national parks, the permit for the right to stay in the specified specially protected natural territories;

b) to check documents on the right to carry out environmental management and other activities in the territories of state natural reserves and national parks adjacent to the territories of protected areas adjacent to the territories;

c) to detain in the territories of state natural reserves, national parks and their protected zones persons who have violated the legislation of the Russian Federation on specially protected natural territories, and to deliver these violators to law enforcement agencies;

d) to send materials on bringing persons guilty of violations of the established regime of state natural reserves and national parks to administrative responsibility;

e) withdraw from the violators of the legislation of the Russian Federation on specially protected natural territories the products and instruments of illegal use of natural resources, vehicles, as well as relevant documents;

f) make on the territories of the state natural reserves, national parks and their protection zones inspection of vehicles, personal belongings;

g) freely visit any objects located on the territories of state natural reserves, national parks, their protected zones to verify compliance with the requirements of the legislation of the Russian Federation on specially protected natural territories;

h) has become invalid after ninety days after the day of official publication of the Federal Law of May 9, 2005 N 45-ФЗ.

2. The main state inspectors and their deputies to protect the territories of state natural reserves and national parks are also entitled to:

a) to prohibit economic and other activities that do not comply with the established regime of state natural reserves, national parks, and their protected areas;

b) impose administrative penalties for violations of the legislation of the Russian Federation on specially protected natural territories;

c) sue individuals and legal entities for the recovery in favor of state natural reserves and national parks against compensation for damage caused to natural complexes and objects of state natural reserves, national parks, their protected areas as a result of violations of the established regime of state natural reserves and national parks ;

d) in cases provided for by the current legislation, send materials on violations of the legislation of the Russian Federation on specially protected natural territories to law enforcement agencies.

3. State inspectors for the protection of territories of state natural reserves and national parks also enjoy all the rights of officials exercising state forest control and supervision (state forest inspectors), and officials of federal executive bodies in the field of environmental protection.

4. State inspectors for the protection of territories of state natural reserves and national parks in the performance of their duties have the right to use special means in the prescribed manner - handcuffs, rubber sticks, tear gas, devices for forcibly stopping vehicles, service dogs.

5. State inspectors for the protection of territories of state natural reserves and national parks in the performance of the tasks entrusted to them by this Federal Law are permitted to carry service firearms while performing official duties.

The procedure for the acquisition, storage and use of service firearms is governed by applicable law.

6. State inspectors for the protection of the territories of state natural reserves and national parks are provided with body armor and other personal protective equipment.

7. State inspectors for the protection of territories of state natural reserves and national parks are subject to mandatory state insurance in accordance with the legislation of the Russian Federation.


Article 35. Protection of territories of natural parks, state natural reserves and other specially protected natural territories of regional and local significance

1. The protection of territories of natural parks, state natural reserves and other specially protected natural territories is carried out by the state bodies in charge of which they are in the manner prescribed by the regulatory legal acts of the Russian Federation, as well as the regulatory legal acts of the constituent entities of the Russian Federation.

2. Workers engaged in the protection of territories of state natural reserves of federal importance enjoy the same rights as state inspectors for the protection of state natural reserves and national parks.

3. The executive authorities of the constituent entities of the Russian Federation and local governments may protect specially protected natural territories of regional and local significance through structural units specially created for this purpose and endowed with relevant powers.
